1. Who these terms are with. These terms are between the person making the submission (“you”) and Nicholas Bryant-Klair, writing under the pen name Makaio (“the Author”). They apply to all text, names, descriptions, characters, creatures and other material you send through the form (“the Submission”).
2. Voluntary submission and no confidentiality. You submit voluntarily. The Submission is not confidential. The Author does not have to use, review, return or respond to it, and submission does not guarantee appearance in any book or other work.
3. Assignment of rights. In return for the opportunity for the Submission to be considered, you assign to the Author all right, title and interest you own in the Submission, including all present and future copyright and related rights, throughout the world for the full duration of those rights and all renewals and extensions. The Author may register, enforce, transfer, license or otherwise deal with those rights.
4. Back-up licence. If any right cannot legally be assigned, you grant the Author an exclusive, irrevocable, perpetual, worldwide, transferable, sublicensable and royalty-free licence to use, reproduce, adapt, edit, rename, combine, translate, publish, distribute, perform, display, market and exploit the Submission in any media now known or later developed.
5. Changes, credit and payment. The Author may change or combine any part of the Submission and may use it in any book, series, adaptation, merchandise, publicity or other project. You have no right to approve its use. No payment, fee, royalty, profit share, accounting or credit is owed. Any credit the Author chooses to give is voluntary.
6. Moral rights. To the fullest extent permitted by law, you irrevocably waive and agree not to assert all moral rights and similar rights in the Submission, including rights to be identified as author and to object to alteration or treatment.
7. Your promises. You promise that the Submission is your own original contribution, that you have authority to make this agreement, and that the Author’s permitted use will not knowingly infringe another person’s rights. Do not submit material copied from a book, game, film, artwork or another person.
8. Similar ideas. You understand that the Author may already be developing, or may later independently develop or receive, characters, creatures, names or ideas similar to yours. Similarity alone does not create a claim against the Author.
9. Age. You must be at least 16. Contributors aged 16 or 17 must also obtain the agreement of a parent or legal guardian using the form.
10. Electronic agreement. Typing your legal name, completing the declarations and selecting the submission button records your intention to sign and accept these terms electronically.
11. Law. These terms are governed by the law of England and Wales. If part of them cannot be enforced, the remaining terms continue. Nothing excludes rights or liabilities that cannot lawfully be excluded.
